    1. Scope of application

    The following General Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

    A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or self employed professional activity.

    2. Contracting party, conclusion of contract, correction options

    The purchase contract is concluded with Kubus und Kugel Art UG.

    By listing products in our online shop, we make a binding offer to conclude a contract for these products. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.

    3. Contract language, storage of contract text

    The language or languages available for the conclusion of the contract: German, English

    We store the contract text and send you the order data and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

    4. Delivery conditions

    Delivery options

    We ship the products to the delivery address specified during the order process.

    You generally have the option to collect your order from Werkstatt Uwe von Loh, Winsstraße 31, 10405 Berlin, Germany during the following business hours: by arrangement.

    5. Payment

    5.1 Prices

    The prices stated at the time of the order apply. These are total prices and include statutory value added tax where the product is subject to VAT.

    5.2 Payment methods

    The following payment methods are generally available in our shop.

    Cash payment on collection
    You pay the invoice amount in cash when collecting your order.

    Credit card
    You enter your credit card details during the ordering process. Your card will be charged immediately after the order is placed.

    PayPal
    In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22 to 24 Boulevard Royal, L 2449 Luxembourg, you must be registered with PayPal, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. Further information is provided during the ordering process.

    PayPal may offer additional payment options in the customer account to registered PayPal customers selected according to PayPal’s own criteria. However, we have no influence on the offering of these options. Any additional individually offered payment options concern your legal relationship with PayPal. Further information can be found in your PayPal account.

    6. Warranty and guarantees

    6.1 Liability for defects

    The statutory rights for defects apply.

    In the case of handmade or artistic works, especially sculptures and print editions, minor deviations in color, structure, surface or dimensions are unavoidable and do not constitute a defect in the legal sense.

    Likewise, deviations resulting from the artistic production process, the natural properties of materials such as bronze, wood or paper, or from handcrafted finishing do not constitute defects.

    Liability for damage caused by improper handling, storage or installation is excluded.

    6.2 Guarantees and customer service

    Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.

    7. Dispute resolution

    We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
